Terms and Conditions
1. General Stipulations
The Terms and Conditions outlined below apply to all orders made with and distributions
from www.bestswisswatch.com.
We reserve the right to change the General Terms and Conditions.
Variations from the above Terms and Conditions are only legally binding if we have agreed
in writing the alterations.
We explicitly reject any testiment made to the customer’s general terms and conditions.
In these terms and conditions:
"We" and "us" means www.bestswisswatch.com
"You" and “the customer” means the person placing an order.
“Both parties” means www.bestswisswatch.com and the person placing the order.
2. Products
a) We only sell genuine brand new watches.
3. Prices
a) All prices include (‘prices’ are all prices which are shown on the website or conveyed
through e-mail):
· Insurance
· Shipment (worldwide & handling)
b) bestswisswatch.com quotes prices in USD.
c) We reserve the right to change prices at any time without notice which are:
· shown on the website or
· relate to an request for information made and conveyed through e-mail.
N/B Prices will be considered final and not subject to change once the customers order
has been confirmed by us.
4. Taxes & Duties
a) Customers are required to pay on receipt of goods purchased all relevant taxes and duties
directly to the shipping representative.
5. Orders
a) By completing and submitting an electronic order form you are making an offer to purchase
goods which, if accepted by us, will result in a binding contract. Orders can be made on our
website 24hrs per day.
b) We reserve the right to refuse an order.
6. Payment Options
a) Payment of the full purchase price is required from the customer to bestswisswatch.com
before an order is shipped. On the occasion that a watch is not in stock we reserve the
right to request a deposit payment. You will be informed of this requirement on placement of order.
b) Methods of Payment.
I. Payment can be made (of the full purchase price as indicated at the time of sale) by any
of the following ways:
· Bank Transfer
· Cheque (We reserve the right to refuse a cheque)
· VISA or MASTERCARD (under US$ 10'000.00)
N/B If paying by means of cheque shipment of the purchased item will only take place once
the clearance of the cheque has taken place through our chosen bank.
II. We accept VISA or MASTERCARD card for all orders under US$ 10'000.00.
This is subject to a 5% surcharge.
For safety reasons we will need the billing address and according to the VISA or MASTERCARD terms we will ship to this address only!
Each billing address is checked by VISA or MASTERCARD before the shipment. If the billing country and the shipping country are not the same the buyer must choose the Bank transfer option.
N/B To use this method of payment the cardholder’s name and billing address must correspond
to the same delivery details.

c) We reserve the right to refuse any VISA or MASTERCARD card without reason.
7. Delivery
a) You will receive your purchase via FedEx Express shipping service. We communicate all
tracking numbers via e-mail once the order has been despatched.
b) FedEx Express offers:
· "worldwide delivery” to over 200 countries
· Estimated delivery time one to two days, depending on the destination".

N/B We do not make any express or implied guarantees with regard to FedEx shipping times
and excludes all liability relating there to.
c) We have undertaken to insure all deliveries through bestswisswatch.com.
8. Delivery Time
a) Once payment has been received, all watches in stock are shipped immediately.
b) On occasion that an item is not in stock we will notify you via e-mail on placement
of your order with the expected delivery date. In the event of any changes to this we will
contact you via e-mail.
c) In the unlikely event that we are not able to supply a watch and the order has been
accepted by us, we will refund the full amount paid to the customer.
N/B We will not be liable and will not reimburse any further costs that may have been
suffered in relation to the order.
9. Transfer of Title and Risk
a) It is upon shipment of the watch title and risk is passed.
10. Warranty
a) Unless otherwise specifically stated, all manufacturer’s warranties are for a period of 24 months.
b) The watches can be taken to a manufacturer’s approved dealer for any necessary repairs.
N/B This can only take place within the warranty period.
d) We also accept watch returned to us for repair during the warranty period and
repair or arrange to repair all defects at no cost to the customer.
N/B Defects will only be repaired under the following conditions:
· Defects have to have occurred within the warranty period, and
· We have to have been made aware of this defect immediately, in writing.
· The defect was not caused by any negligence by the customer, incorrect treatment or
inadequate maintenance.
11. Legal Responsibility
a) bestswisswatch.com shall only be liable for watch defects which appear and have been
properly notified in writing within the warranty period, provided the defect was not caused
by improper use, insufficient maintenance or negligence by the customer.
b) Where paragraph (a) above applies, the customer agrees that we will repair the defect,
to the exclusion of all other available remedies.
c) We shall be hereby excluded from any liability for indirect damages caused or materially
contributed to by the FedEx distribution system.
12. Return Policy
a) During the warranty period only, watches be returned to us and only under
the following reasons:
· the purposes of repair
· an incorrect item has been delivered
13. Data Protection and Privacy
a) We strive to protect our customer’s privacy and the safe transfer of all data to the
best possible standard as is reasonable. We undertake the following precautions to achieve this:
b) Use of Data:
· All personal data is treated in the strictest confidence.
· We only request information required to fulfil an order.
· We may also use your personal information to contact you about news and offers that we
think may interest you, or to tell you if we change anything important about how the website
works, or the terms of use of the website.
c) Transfer of Data:
· We only transfer data when essential to fulfil the agreement with the customer.
· We will not transfer, send or sell any personal data to third parties.
d) Storage of Data:
· All personal data provided is stored for internal use only, to aid purchases for current customers
· All data is stored in a secure computer system and kept for as long as is permitted by law.
e) Credit Card Data:
· All purchases undertaken by way of credit card are made using our secure order form.
· Any purchase made through us bestswisswatch.com will show as on credit card statements.
14. Applicable Law & Jurisdiction
a) This agreement is subject to Swiss law, excluding the conflict of law rules.
b) The place of jurisdiction for any disputes arising from this or in connection with this
agreement will be where bestswisswatch.com registered office is located.
